EVAGO Aesthetics (“EVAGO,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit (https://evago.co/) (the “Site”), purchase products through the Site, contact us, subscribe to marketing communications, or use other online services that link to this Privacy Policy.

This Privacy Policy applies to EVAGO’s handling of personal information. It does not apply to the independent practices of third-party websites or services, such as Square, that you may access through links on the Site. It also does not replace any separate privacy notice, consent form, or other notice that may be provided in connection with an in-person treatment.

1. Personal Information We Collect

The personal information we collect depends on how you interact with us.

Information you provide directly

We may collect:

  • Contact information, such as your name, email address, telephone number, billing address, and shipping address.
  • Order and transaction information, such as products purchased, order amount, delivery details, purchase history, refunds, and related communications.
  • Payment information. Payment-card information submitted during online checkout is processed by our payment provider, Square. We generally receive transaction confirmations and limited payment details, such as the card type and last four digits, rather than the full card number.
  • Appointment and gift-card information. When you follow a link from the Site to book an appointment or purchase a gift card through Square, Square may collect your contact, appointment, recipient, payment, and transaction information under its own privacy notices.
  • Communications, including the name, email address, phone number, subject, message, and any other information you submit through our contact form or provide when you call, email, text, or otherwise communicate with us.
  • Marketing information, such as your email address, communication preferences, and interactions with marketing messages when you subscribe to our mailing list.
  • Review or social information, such as a display name, review, comment, or other content you choose to submit or make public.
  • Treatment-related or sensitive information that you voluntarily include in an inquiry or booking. Please do not send medical records, photographs of treatment areas, or other sensitive health information through the Site’s general contact form. Contact us by phone if you need a more appropriate way to provide such information.

Information collected automatically

When you use the Site, we and our service providers may automatically collect:

  • IP address and approximate location derived from it;
  • browser type, operating system, device type, language, and device identifiers;
  • referring and exit pages, pages viewed, links clicked, date and time of access, and other Site interactions;
  • shopping-cart and checkout activity; and
  • cookie identifiers and information collected through cookies, pixels, tags, local storage, and similar technologies.

Information from other sources

We may receive information from payment and booking providers, shipping carriers, website and analytics providers, email-marketing services, social-media platforms, fraud-prevention services, and other service providers. We may combine this information with information collected through the Site.

2. How We Use Personal Information

We may use personal information to:

  • operate, maintain, personalize, and improve the Site;
  • process, fulfill, deliver, and support orders, payments, returns, and refunds;
  • facilitate appointments and gift-card purchases;
  • respond to questions, requests, reviews, and customer-service inquiries;
  • send administrative or transactional messages;
  • send newsletters, promotions, or other marketing communications where permitted by law;
  • understand Site traffic, measure advertising and marketing performance, and improve our products and services;
  • maintain the security and integrity of the Site, detect or prevent fraud and misuse, and troubleshoot technical issues;
  • comply with law, enforce our agreements, establish or defend legal claims, and protect our rights and the rights and safety of others; and
  • carry out another purpose disclosed when the information is collected or with your consent.

3. Cookies and Similar Technologies

We use cookies and similar technologies for several purposes:

  • Essential and functional technologies support core features such as security, page navigation, shopping-cart functions, and checkout.
  • Analytics technologies help us understand how visitors use the Site. The Site uses Google Analytics through Google Tag Manager and may use analytics services associated with WordPress, Jetpack, and WooCommerce.
  • Marketing technologies may help us measure campaigns and understand whether visitors take actions such as clicking a phone number, booking link, gift-card link, or contact-form submission.
  • Embedded and third-party content may allow providers such as Instagram or Facebook to collect information when you view or interact with their content or links.

You can control cookies through your browser settings. Blocking certain cookies may cause parts of the Site, including the shopping cart or checkout, to work incorrectly. You can also use the Google Analytics opt-out browser add-on. The Site may not respond to “Do Not Track” signals. Where required by applicable law, we will treat a recognized opt-out preference signal, such as Global Privacy Control, as a request to opt out for the browser or device sending the signal.

4. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients:

  • Website, hosting, e-commerce, and security providers, including providers that support WordPress, Jetpack, and WooCommerce.
  • Payment, booking, and gift-card providers, including Square.
  • Email and marketing providers, including Mailchimp.
  • Analytics and measurement providers, including Google Analytics and Google Tag Manager.
  • Social-media and content providers, including Meta platforms such as Instagram and Facebook.
  • Shipping, fulfillment, and logistics providers, such as postal services and private carriers.
  • Professional advisers, including attorneys, accountants, insurers, auditors, and consultants.
  • Government authorities or other parties for legal and safety reasons, when we reasonably believe disclosure is required by law or necessary to protect rights, safety, property, or the integrity of our services.
  • Parties to a business transaction, such as a merger, financing, acquisition, reorganization, bankruptcy, or sale of all or part of our business or assets.
  • Other parties at your direction or with your consent.

These providers may process information under their own privacy notices. For more information, review the privacy notices of Square, Google, Mailchimp/Intuit, Meta, and Automattic.

5. Sale, Sharing, and Targeted Advertising

We do not sell personal information for money. Some state privacy laws define “sale,” “sharing,” or “targeted advertising” broadly enough to include certain disclosures of online identifiers and internet activity to analytics or advertising providers through cookies and similar technologies. To the extent our practices are treated as a sale, sharing, or targeted advertising under applicable law, residents of covered jurisdictions may request to opt out as described in Section 9.

We do not knowingly sell or share for cross-context behavioral advertising the personal information of individuals under 16 years of age.

6. Marketing Communications

You may unsubscribe from promotional emails at any time by using the unsubscribe link in the message or by contacting us. If you opt out of marketing, we may still send non-promotional communications, such as messages about an order, appointment, payment, request, or our ongoing business relationship.

If you separately consent to receive marketing text messages, you may withdraw that consent by replying STOP. Consent to marketing texts is not a condition of purchase. Message and data rates may apply.

7. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide products and services, maintain business and transaction records, comply with legal, tax, accounting, and regulatory obligations, resolve disputes, prevent fraud, and enforce agreements.

Retention periods vary depending on the type and sensitivity of the information, the purposes for which it was collected, whether we have an ongoing relationship with you, and applicable legal requirements. When personal information is no longer reasonably necessary, we may delete, de-identify, or aggregate it, subject to information retained in backups or as required by law.

8. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no website, internet transmission, or storage system can be guaranteed to be completely secure. You are responsible for using appropriate caution when sending information online.

9. Your Privacy Rights and Choices

Depending on where you live and subject to applicable law, you may have the right to:

  • confirm whether we process your personal information and access that information;
  • correct inaccurate personal information;
  • request deletion of personal information;
  • obtain a portable copy of certain personal information;
  • opt out of certain sales, sharing, targeted advertising, or profiling;
  • withdraw consent where processing is based on consent; and
  • appeal our denial of a privacy-rights request.

Please describe your request and provide enough information for us to identify the records at issue. We may take reasonable steps to verify your identity and authority before acting on a request. If we cannot verify a request, an exception applies, or the law does not provide the requested right, we may be unable to fulfill it.

Where permitted by law, an authorized agent may submit a request on your behalf. We may require proof of the agent’s authority and may ask you to verify your identity directly. You will not be discriminated against for exercising an applicable privacy right.

To appeal a decision, reply to our response or send a new email with the subject line Privacy Appeal and explain why you believe the decision should be reconsidered.

10. Supplemental Notice for Residents of Certain U.S. States

We collect these categories from you, your device, our service providers, and social-media or other third-party services. We use and disclose them for the purposes described in Sections 2 and 4. We do not use or disclose sensitive personal information to infer characteristics about you.

We do not offer financial incentives or different prices based on the exercise of privacy rights. Ordinary discounts, promotions, loyalty benefits, or gift-card offers may be subject to separate terms and are not payments for personal information.

11. Children’s Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information online from children under 13. If you believe a child under 13 has provided personal information through the Site, contact us so we can take appropriate action.

12. Third-Party Links and Services

The Site links to or integrates services operated by third parties, including Square booking and gift-card pages and social-media platforms. We do not control these third parties or their privacy practices. Information you provide directly to a third party is governed by that party’s privacy notice. We encourage you to review the applicable notice before providing personal information.

13. International Visitors

EVAGO is based in the United States. If you access the Site from another country, your information may be processed in the United States and other countries where we or our service providers operate. These countries may have privacy laws different from those in your jurisdiction.

Where applicable law requires a legal basis for processing, we rely on one or more of the following: performance of a contract or steps requested before entering a contract; our legitimate interests in operating, improving, securing, and marketing our business; compliance with legal obligations; and consent.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The revised version will be posted on this page with a new “Last updated” date. If a change is material, we may provide additional notice as required by law. Your use of the Site after an updated policy becomes effective is subject to the updated policy.
